1. General Provisions and Subject of Agreement
1.1. This Terms of Service agreement (hereinafter — the "Agreement") governs the terms and conditions for accessing and using the "Kiosk" (ZnaetAPPS) mobile app catalog and distribution platform accessible at https://apps.znaetapps.ru and inside the Kiosk mobile app (hereinafter — the "Service").
1.2. The Operator and Administrator of the Service is Individual Entrepreneur Maxim Igorevich Kapultsevich (hereinafter — the "Administration").
1.3. By accessing the Service, creating an account, or downloading applications, Users and Developers unconditionally accept this Agreement and the Privacy Policy.
1.4. The current version of the Terms of Service is publicly available at: https://apps.znaetapps.ru/terms.
2. Distinction Between Users and Developers
The Service clearly establishes the rights, obligations, and responsibilities for distinct categories of participants:
2.1. User — an individual who uses the Service to search, discover, download, install, and review mobile applications for personal non-commercial purposes.
2.2. Developer (Publisher) — an individual or legal entity registered as a developer within the Service to publish applications, maintain developer posts, and distribute software.
3. User Rights and Obligations
3.1. Users may freely use catalog search features, download, and install available apps for personal non-commercial use.
3.2. Users agree to:
- Provide accurate information during registration and profile management;
- Refrain from attempting to breach system security, disrupt servers, or scrape data;
- Maintain respectful conduct and adhere to applicable laws when submitting reviews and ratings.
4. Developer Obligations and Responsibilities
4.1. Developers publish apps and content in strict compliance with the Developer Rules, which constitute an integral part of this Agreement.
4.2. By submitting an application, the Developer warrants and guarantees that:
- They are the legitimate copyright owner or possess all necessary licenses and permissions to distribute the software;
- The application is free from malicious code, spyware, viruses, unauthorized telemetry, and traffic bypass/VPN evasion tools;
- App descriptions, icons, and screenshots are accurate, truthful, and comply with all applicable legal requirements.
4.3. The Administration reserves the right to reject, hide, or remove any application or developer account upon violation of platform rules without liability.
5. Intellectual Property and Third-Party Content
5.1. All trademarks, copyrights, and intellectual property rights belong to their respective creators and copyright owners.
5.2. Third-party Free Apps and Fair Use: The Administration may index and distribute freely available third-party applications from public sources under the Fair Use principle for user convenience and informational purposes. The Administration claims no ownership of such software and maintains original package integrity.
5.3. Notice and Takedown Procedure: Copyright owners wishing to update or remove their content from the catalog may contact the Administration at support@znaetapps.ru with proof of rights for prompt review and resolution.
6. Limitation of Liability
6.1. The Service is provided on an "as is" and "as available" basis without warranties of any kind.
6.2. While the Administration conducts security reviews of submitted packages, it is not liable for third-party developer software performance or issues arising on end-user devices.
7. Final Provisions
7.1. This Agreement is governed by the laws of the Russian Federation.
7.2. The Administration may amend this Agreement and Developer Rules at its discretion. Updated versions become effective upon publication.
